- The 60% income-tax effect in the allowance-taper band is not a 60% tax rate on your entire salary; Scotland has different bands.
- Tax residence is assessed under the Statutory Residence Test, not by a visa, foreign address or P85 alone.
- Certain gains and income can be taxed in the year of return after temporary non-residence. Get the exact residence periods checked before selling.
- Ordinary voluntary Class 2 contributions for time abroad are no longer available for 2026/27 onward; Class 3 and transitional eligibility need a fresh check.
What the UK's residence and departure rules assess
You may still have a home, partner, children, rental property or company in Britain. Those continuing connections belong in the plan from the start.
It is particularly useful before a bonus, share disposal, company dividend, pension withdrawal or relocation package becomes payable.
The order and dates can matter as much as the headline rate.
For Scottish taxpayers, use the Scottish schedule rather than the England/Wales/Northern Ireland illustration below.
A move can improve your finances. It can also replace one familiar tax bill with several unfamiliar costs.
This guide covers departure planning for the UAE, Spain and Portugal.
It does not claim an “exodus” or promise that a new address stops HMRC from taxing you.
Compare the same income
The standard Personal Allowance reduces by £1 for every £2 of adjusted net income above £100,000 and is gone at £125,140.
In the 40% band, that produces a 60% income-tax effect on that slice. It is not a separate 60% band applied to all earnings.
Pension contributions and other adjustments can change the calculation. HMRC — income-tax rates and Personal Allowance.
A foreign employee salary, freelance turnover and company profit are three different quantities.
Do not compare a British payslip after deductions with a UAE business invoice before licence fees, expenses and taxes.
| Question | Evidence to obtain | Why it changes the comparison |
|---|---|---|
| Will gross pay stay the same? | Written employer package and payroll location | A lower local package can absorb a tax difference |
| Who pays insurance, school and pension costs? | Benefit schedule, exclusions and cash allowances | Gross pay is not the whole compensation package |
| Which country taxes work days? | Work-location diary and adviser’s allocation | UK duties can remain relevant after departure |
| What remains at home? | Mortgage, rent, support and account restrictions | Two sets of bills reduce cash available abroad |
For a UAE move, check UAE residence and business routes against the work you will actually do.
Why retained ties and returning sooner matter
Household example: a £140,000 employee, not a company owner
- Illustrative calculation: a full-year England/Wales/Northern Ireland employee earns £140,000 in 2026/27, with no pension deductions, benefits, student loan, other income or special tax code.
Income tax is £49,203. A standard category-A employee NI approximation is £4,810.60.
That leaves £85,986.40 annually, or about £7,166 monthly. Payroll rounding can differ.
The allowance is fully tapered away. HMRC — 2026/27 payroll rates and thresholds.
- If that person genuinely becomes UAE-resident, keeps the same foreign salary, and has no continuing UK or other-country liability on it, the modeled local wage income-tax difference could be substantial.
A contractor’s £140,000 of invoices needs a different model.
For Spain, do not substitute 24% until Article 93 eligibility and the income treatment are confirmed. Ordinary IRPF and social contributions are the fallback.
For Portugal, an attractive residence route does not grant IFICI.
Build two budgets: the treatment you can document today and the conditional treatment you hope to obtain.
Traps to avoid
- Comparing employee net salary with freelance revenue or company cash.
- Treating a residence visa, overseas lease or departure form as an SRT result.
- Ignoring Scottish bands or adjusted net income when quoting the 60% effect.
- Selling a pre-departure asset before checking a possible early return.
- Budgeting outdated voluntary Class 2 rates for new periods abroad.
- Assuming a destination tax incentive is approved because the visa is approved.
Ask your employer about company-presence, payroll and social-security issues too. Your personal tax residence does not remove its obligations.
A visa, a tax position and a work arrangement need their own checks.
- 1Can you live and work there?
Check the route for the work you will actually do.
- 2Where will you owe tax?
Map your days, income types and continuing home-country ties.
- 3Who handles the paperwork?
Confirm payroll, contributions, filings and deadlines before committing.
If your budget relies on the special rate, check Beckham Law eligibility before committing to it.
How to prepare departure evidence and a return plan
Residence: work through the test, then keep the evidence
The SRT has automatic overseas tests, automatic UK tests and a sufficient-ties test where neither settles the position.
Days alone do not answer every case.
A full-time overseas-work route also involves limits on UK presence and UK work days, sufficient working hours and breaks; it is not simply “35 hours abroad.”
Use the complete HMRC test rather than a checklist fragment.
Work through the complete HMRC RDR3 Statutory Residence Test (SRT) Guidance alongside your travel and work records.
- Keep midnight presence and work-duration records, but also retain contracts, usable-home dates and travel evidence. Deemed days and exceptional circumstances have conditions.
HMRC — Statutory Residence Test guidance.
| File | What to record | What not to assume |
|---|---|---|
| Travel | Arrival/departure dates, UK midnights and supporting tickets | A short visit is always irrelevant |
| Work | Where duties were done and hours on each UK day | An overseas payroll makes every day foreign work |
| Homes and family | Availability, use, spouse/partner and child circumstances | Renting out one home resolves every tie |
| Departure year | Full-year analysis and any qualifying split-year case | Split-year treatment is automatic from the flight date |
A residence opinion is useful because it makes assumptions visible.
Ask it to state the departure-year result, treatment of UK work visits and the records you must keep if your plans change.
What happens if you return sooner than planned?
HMRC’s temporary non-residence rules can apply where the relevant period is five years or less and the prior-residence conditions are met.
The period is determined using residence periods, including qualifying split years—not by a casual instruction to stay away for five full calendar or tax years.
HMRC — temporary non-residence definition.
- Before a sale, ask for an asset-by-asset answer: acquisition date, UK property exposure, gain, company ownership, pension or distribution treatment and a realistic return date.
Keep the written advice with the transaction evidence.
Assets bought after departure and disposals of UK land can have different treatment; “all gains are tax-free while abroad” is not a safe summary.
HMRC — temporary non-residence and capital gains, 2026.
Build a return budget even when the move feels permanent. A family illness, schooling issue or job change can shorten the stay.
A tax plan that only works if life never changes is a fragile one.
Your pension and ongoing UK obligations
From 2026/27, ordinary voluntary Class 2 for time abroad is unavailable.
- New Class 3 applications generally need ten continuous years of UK residence or ten qualifying contribution years; there are transitional conditions for earlier applicants.
Special social-security-agreement and development-worker cases need separate treatment. Ask HMRC which years and class apply to you.
HMRC — voluntary National Insurance abroad from April 2026.
- For the application process and current eligibility, use HMRC Form CF83 for Voluntary National Insurance; submitting the form does not guarantee that every gap can be filled.
Keep a separate list for UK property, investments, student debt, benefits and registered pensions.
Do not retain an incorrect address just to keep a product working.
The residence-based foreign-income-and-gains system introduced in April 2025 is a distinct question, especially for returning people with a long non-UK history.
It is not a general exemption for anyone leaving or returning. Give the adviser your prior residence history, not only your citizenship.
Practical departure checklist
- Write down the income type, gross package and employer’s overseas-work approval.
- Prepare an SRT travel, work, home and family evidence file.
- Get a departure-year and early-return opinion before major disposals.
- Price ordinary destination tax and a documented conditional alternative.
- Check pension forecasts and current HMRC contribution eligibility.
- Include home bills, insurance, school costs, currency friction and return cash.
Use the budget tool for household cash, not just the tax difference.
If the destination authority requires legalised UK documents, check the FCDO Legalisation Office guidance before ordering an apostille or translation.
If a police certificate is required, use the ACRO Criminal Records Office Police Certificate service and confirm the requesting authority accepts it.
Check current processing and delivery notices before booking non-refundable travel.
When to hire an adviser—and what to ask
- Get coordinated UK and destination advice for share awards, a company you control, UK property, a spouse remaining in Britain, substantial work visits or a planned return within several years.
Ask: “Which residence test applies, what could change the result, which income remains taxable, what do I report, and what happens if I return in year three?”
Use our adviser briefing checklist to avoid spending the first appointment reconstructing the basics.
Keep departure tax records separate from the destination application.

Frequently Asked Questions
Does leaving before April automatically make me non-resident?
No. Apply the Statutory Residence Test to the actual year and facts, including work, days and ties.
Split-year treatment also has conditions and should not be assumed from the departure date. HMRC: Statutory Residence Test (RDR3).
Can I keep paying into an ISA abroad?
Generally new subscriptions stop while non-resident, subject to HMRC’s stated exceptions.
Existing holdings can remain, but destination tax treatment is separate and the provider must be informed. HMRC: ISAs when moving abroad.
Does returning within five years always tax every gain?
No. Temporary non-residence has specific scope and conditions.
Have the relevant income or gain reviewed rather than treating the period as a universal charge on every transaction.
